Payment Terms: Subscriptions are billed in advance on a monthly or annual basis. Payment is processed securely through Stripe.

Price Changes: We may change our prices with 30 days' notice. Price changes will not affect your current billing cycle.

Refunds: We do not provide refunds for partial months or unused portions of your subscription.

7. Cancellation and Termination

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support.

Service Termination: We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Data Retention: Upon cancellation or termination, your data will be retained for 30 days, after which it may be permanently deleted.

8. Service Availability

Uptime: We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service.

Maintenance: We may perform scheduled maintenance that may temporarily interrupt service.

Third-party Dependencies: Our Service depends on third-party platforms (Instagram, YouTube, TikTok) and their availability.

Force Majeure: We are not liable for service interruptions caused by events beyond our control.

9. Comprehensive Disclaimers & Liability Limitations

Service Limitations: The Service is provided “as is”, “as available”, and “with all faults” without any warranties of any kind, either express or implied.

No Guarantees: We make no guarantees that the Service will work properly, be uninterrupted, error-free, secure, or meet your specific requirements.

Service May Break: The Service may malfunction, break, or become unavailable at any time without notice. We are not responsible for any losses resulting from service interruptions.

Third-Party Dependencies: Our Service depends on third-party platforms (Instagram, YouTube, TikTok, etc.) that may change their APIs, terms, or functionality at any time. We are not responsible for any issues caused by these third-party changes.

Content Loss: We are not responsible for any loss, corruption, or deletion of your content, posts, or data. You are responsible for backing up your own content.

Posting Failures: We cannot guarantee that your posts will be published successfully. Technical issues, platform changes, or other factors may cause posts to fail or be delayed.

Account Bans/Suspensions: We are not responsible if your social media accounts get banned, suspended, or restricted due to using our Service or any content you post.

Liability Cap: Our total liability to you for any claims arising from the use of our Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is less.

Excluded Damages: We are not liable for any indirect, incidental, special, consequential, punitive, exemplary, or aggravated damages, including but not limited to lost profits, lost revenue, lost business opportunities, lost data, emotional distress, or any other intangible losses.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, fire, natural disasters, government actions, internet outages, or third-party service failures.

  • Account Issues: Your social media accounts may be affected by using our Service
  • No Backup Guarantee: We do not guarantee that your data will be backed up or recoverable

Your Responsibilities: You are responsible for:

  • Backing up your own content and data
  • Monitoring your scheduled posts to ensure they publish successfully
  • Complying with all social media platform terms and policies
  • Not relying solely on our Service for critical business operations
  • Having alternative posting methods available

No Reliance: You should not rely on our Service for any critical business operations, time-sensitive communications, or any purpose where failure could result in significant losses.

11. Indemnification

You agree to defend, indemnify, and hold harmless PostWizard and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service.
